Surf Spirit Online Shop Terms and Conditions

1. Scope

1.1 The following general terms and conditions (GTC) apply to all deliveries to consumers.

1.2 A consumer is any natural person who concludes a legal transaction for a purpose that can primarily be attributed neither to their commercial nor to their independent professional activity.

2. Contracting partner

The purchase contract is concluded with Surf Spirit GmbH & Co. KG, Am Lenkwerk 7, 33609 Bielefeld.

3. Conclusion of contract

3.1 We conclude contracts via www.surf-spirit.com exclusively in German.

3.2 The presentation of the products does not represent a legally binding offer, but only an invitation to order.

3.3 By clicking on the [Buy now] button, you are making a binding offer to conclude a purchase contract for the items listed in the shopping cart. The purchase contract is concluded when you receive a transaction confirmation from PayPal.

3.4 In the event that we are unable to deliver the ordered goods through no fault of our own because our supplier has not fulfilled its contractual obligations despite a proper order, we are entitled to withdraw from the contract with you. In this case, you will be informed immediately that the ordered product is not available and any payments already made will be refunded immediately. Your legal rights remain unaffected.

4. Right of withdrawal

4.1 If you are a consumer, you have a right of withdrawal in accordance with legal provisions.

4.2 If, as a consumer, you make use of your right of withdrawal in accordance with section 4.1, you must bear the costs of returning the goods.

4.3. In addition, the rules for the right of withdrawal apply, which are set out in detail in the following cancellation policy:

Right of Withdrawal

You have the right to cancel this contract within fourteen days without giving reasons. The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took or has taken possession of the goods. If the goods ordered in a single order are delivered separately, the cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the last goods.

In order to exercise your right of withdrawal, you must inform us (Surf Spirit GmbH & Co. KG, Am Lenkwerk 7, 33609 Bielefeld, management@surf-spirit.info) of your decision to cancel this contract by means of a clear statement (e.g. a letter sent by post or email). You can use the attached sample withdrawal form, but this is not mandatory.

To meet the withdrawal period, it is sufficient that you send the notification that you have exercised your right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you cancel this contract, we will reimburse you all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), immediately and at the latest within fourteen days from the day on which we receive notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used for the original transaction, unless something else has been expressly agreed with you; in no case will you be charged for this repayment.

We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier. You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling them that is not necessary to check the nature, properties and functioning of the goods.

4.4 You do not have the right of withdrawal for contracts for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by you is decisive or which are clearly tailored to your personal needs.

5. Prices and shipping costs

5.1 The prices listed on the product pages are final prices, i.e. they include the statutory value added tax and other price components.

5.2 In addition to the prices quoted, we charge for delivery

- within Germany, a flat rate of 4.90€,

- to Austria, Belgium, Luxembourg and the Netherlands, a flat rate of 11,90€,

- to Denmark, Liechtenstein, Czech Republic, France, Great Britain, Monaco

and a flat rate of 16.90€ to Switzerland,

- to Italy, Poland, Slovenia, Hungary and Slovakia, a flat rate of 19,90€,

- to Ireland, Portugal, Spain and Sweden for a flat rate of 24.90€

per order.

The shipping costs will be clearly shown to you again on the product pages, in the shopping cart system and on the order page.

6. Delivery

6.1 Delivery within Germany is carried out by DPD or DHL.

6.2 The delivery time within Germany is up to seven working days from receipt of the shipping confirmation. We will point out any deviating delivery times on the respective product page.

6.3 Unless otherwise agreed, delivery will be made to the delivery address provided by you.

7. Payment

7.1 Payment is made via PayPal. For every order, we reserve the right not to offer this means of payment and to refer to another means of payment.

7.2 You agree that you will only receive invoices in electronic form.

7.3 Any repayments that we are obliged to make as part of the rescission of the purchase contract as a result of a cancellation or following exercise of a statutory warranty right are made via PayPal.

8. Statutory liability for defects and further information

8.1 Statutory liability for defects applies.

8.2 We do not offer products for sale by minors. Our products can only be purchased by adults. If you are under 18, you may only place orders with the assistance of a parent or legal guardian.

8.3 We reserve the right to make changes to our website and these terms and conditions at any time. Your order is subject to the terms and conditions in force at the time you place your order. If any provision in these terms and conditions is invalid, it is considered severable and does not affect the validity and enforceability of the remaining provisions.

9. Dispute resolution

Surf Spirit GmbH & Co. KG does not currently participate in an alternative dispute resolution procedure under the Consumer Dispute Resolution Act, which is voluntary for them. Therefore, such a procedure and also the online dispute resolution platform provided by the EU Commission at http://ec.europa.eu/consumers/odr/ cannot be used.
